The court sitting over the vacant Alajede stool legal tussle continued on Tuesday, at the Lagos High Court, after a long break, only for the matter to be adjourned again.
The case was adjourned till November 14, when the final written address will be adopted, while the court, presided over by Justice Lawal Akapo of the Lagos State High Court sitting at the Ikeja High Court Complex, directed the Complainant’s lawyer to regularize the process of serving the other parties with his responses.
THE IMPACT gathered that the Claimant’s lawyer, in the Suit No: IKD/82/2013, had served the Defendants’ separately with his responses rather than issuing a single response to the parties.
He was directed to issue a proper reply within seven days.
Also in court were lawyers to all the parties, including that of the Lagos State Government.
Prince Tajudeen Yunusa, General Secretary, Idowu Ajanaku royal family, speaking with THE IMPACT, after the adjournment, said that the court was unable to adopt the final written address on the matter that will pave way for judgment soon, due to technicalities.
“We were unable to adopt the final written address due to some technicalities, and the matter has been adjourned till November 14, for the adoption of the final written address”, he said”.
“The inability of the court to adopt the final adjournment was because the Claimant’s lawyer who was supposed to present just one reply to our own address and give same to the Defendants and the government’s lawyer, was unable to do so.
“Instead, he gave different responses to the parties and the judge directed him to do another response and serve necessary parties within seven days”, Prince Yunusa said.
Prince Kazeem Amusa, who is the first Claimant challenging the emergence of Hon. Saheed Hassan as the Alajede – elect, who also spoke with our reporter after the matter, corroborated the statements of the Secretary of Idowu Ajanaku family.
“The matter has been adjourned till November 14, with the court directing that we should regularize the reply of our lawyer to Defendants”, Prince Amusa said.
“Our lawyer has been directed to direct his response to all the Defendants’ lawyers in a single document. That was the only thing that caused the adjournment today (Tuesday)”.
At the court sitting on Tuesday, were Hon. Saheed Hassan Adefarasin, the Alajede – elect (Defendant), High Chief Musediq Aliu, the Regent of Ijede and Chairman, Alajede – in – Council (Defendant), Otunba Adedayo Aba Ajanaku (Defendant), Prince Kazeem Amusa (Claimant), among other family chieftains and residents.
