-As defendant gets N3 Million bail
The Federal High Court sitting in Ikoyi has fixed May 10th and 11th, 2023, for the commencement of trial in a matter filed by the Inspector – General of Police against the former aspirant for the Ikorodu Constituency II seat, Mr Oluwatosin Onamade.
At the resumption of the matter with the Suit No: FHC/1/32C/2021, before the Honorable Justice Ayokunle Faji, on Monday, the court delivered a ruling on the bail application by Onamade. He was granted bail in the sum of N3 Million with two sureties of reasonable means.
Onamade had filed for a bail application on the 2nd day of February, 2022, seeking the following reliefs: An order of the Honourable Court admitting the Applicant to bail pending his trial and for such further or other order(s)as this Honourable Court may deem fit to make in the circumstance.
The application was supported by a 12 paragraph affidavit sworn to by the Defendant/Applicant with exhibits attached and a Written Address were filed in support of the application.
His Counsel raised a sole issue determination to wit:
“Whether, considering the affidavit evidence and the nature of the offences as contained in the charge, the Defendant/Applicant has made out a case to justify his request for bail upon arraignment and pending trial?”
The presiding judge, after disagreeing with the Prosecutor in his counter – application against bail for the Defendant/Applicant, ruled:
“Indeed, the offense is bailable. I grant the defendant bail on the following terms:
“Bail in the sum of N3, 000, 000. 00.
“Two sureties in the like sum.
“Both sureties to show evidence of a reasonable means of livelihood.
“The prosecution shall verify these conditions and give a report within 48 hours of presentation of the documents.
“Sureties to present evidence of payment of income tax for the past three years”.
The court also restated its earlier order that the Defendant must continue to report at the State Criminal Investigation Bureau (SCIB), Panti, every Monday, in the company of his counsel and failing which Justice Faji directed the prosecution to arrest him before the next adjourned date.
The Court also ruled that the bail condition must be fulfilled within 7 days.
